What is the statute of limitation on personal injuries claims?

In personal injury claims, the clock on the two-year time limit stops when the PIAB application has been made. As the Injuries Board does not assess medical negligence claims then the only way to stop the clock on the two-year time limit is to issue court proceedings.

What is the date of knowledge?

The date of knowledge means the date which the injured person gained knowledge of the following facts: - That they had been injured - That the injury was significant - The injury was caused by negligence, nuisance or breach of duty by the party at fault for the accident - They know the identity of the party at fault

How are claims calculated?

At first instance, the Personal Injury Assessment Board is responsible for assessing the claim and provide a monetary value to it. The Judicial Council’s personal injury guidelines is to be followed.
